These contrasting reports not only reflect the deep-seated tensions of the ongoing conflict but also illuminate the complexities surrounding allegations regarding the use of hospitals for militant purposes by Hamas.

Incidents Near Hospitals: A Divergent Perspective

On November 3, 2023, Israel’s Coordinator of Government Activities in the Territories (COGAT), the body responsible for overseeing humanitarian efforts in Gaza, reported a significant incident near Kamal Adwan and Al-Awda hospitals. Amidst attempts to evacuate patients and staff from these facilities, an explosive device detonated just a few hundred meters from Kamal Adwan Hospital. Remarkably, the vehicle convoy tasked with the evacuation remained unharmed; however, it was reported that six children inside the hospital sustained injuries.

Notably, the Hamas-controlled Gaza Ministry of Health did not include any reference to the explosive device in its statements regarding the incident. An IDF spokesperson subsequently explained that the explosion was the result of a device planted by terrorists operating in Gaza.

Accusations of Targeted Strikes

The following day, on November 4, tensions escalated when the Gaza Ministry of Health accused Israeli forces of bombing Kamal Adwan Hospital, further alleging that they sought to execute hospital staff who declined to evacuate. While the New York Times reported on this claim, it briefly mentioned the previous day’s explosion but placed greater emphasis on the accusations coming from the Ministry of Health.

In stark contrast, the IDF spokesperson firmly denied the existence of an attack on the hospital on November 4 and clarified that their forces had conducted a precision strike targeting a terror-related facility located merely 100 meters away. The spokesperson went on to highlight that Hamas had fired over 3,000 rockets that landed within Gaza itself, leading to substantial civilian casualties.

Previous IDF Operations and Findings

Evidence of the IDF’s previous operations at the Kamal Adwan Hospital adds another layer to the narrative. On October 28, 2023, Reuters reported that an Israeli raid resulted in the capture of approximately 100 suspected Hamas militants associated with the hospital. The IDF explained the necessity of verifying hospital staff, as some terrorists were reportedly disguised as medical personnel during the operation. It was also claimed that substantial evidence, including funds, weapons, and intelligence documents linked to Hamas, were uncovered within the hospital premises.

The Gaza Ministry of Health countered the IDF’s portrayal of events, asserting that Israeli forces arrested all medical personnel present, leaving just one pediatrician to tend to the patients. The IDF, however, defended its actions as a necessary response to Hamas utilizing medical facilities for military purposes, including operating within the establishments and hiding operatives disguised as healthcare staff.

Protecting Civilians vs. Targeting Militants

Brig. Gen. Elad Goren, head of COGAT, dismissed the accusations from the Hamas Ministry, insisting that efforts were concentrated on safeguarding non-combatants in Kamal Adwan Hospital while apprehending individuals for interrogation to obtain intelligence regarding Israeli hostages. “If the world wants to believe Hamas, they have a problem with their values,” Goren asserted firmly, encapsulating the tension surrounding the conflicting narratives.

Documented Evidence and International Inquiry

Noteworthy evidence suggesting Hamas’ use of Kamal Adwan Hospital for military purposes has been documented in the past. In December 2023, Ahmad Kahlot, a senior member of Hamas and former director of the hospital, reportedly confirmed during an interrogation that the facility had been used to shield high-ranking militants from IDF airstrikes. The facility allegedly contained areas intended for interrogations and internal security operations

In addition, an October 2024 interrogation of an ambulance driver revealed that Hamas operatives allegedly used hospital ambulances to transport their injured fighters and facilitate military missions, undermining the ambulances’ intended humanitarian purpose.

Despite this evidence, a United Nations (UN) Commission of Inquiry report released in September 2024, which covered Israel’s treatment of Gaza’s healthcare system, failed to mention Hamas’ presence in Kamal Adwan Hospital. Anne Bayefsky, president of Human Rights Voices, criticized the commission for appearing biased in favor of Hamas, neglecting documented evidence of the group’s misuse of hospitals for military operations. Bayefsky also claimed that Israel had provided significant photographic and video evidence that illustrated Hamas operating within hospitals, including tunnels utilized as command centers and as storage space for weapons.

Military Infrastructure: The Tunnels Under Hospitals

Further scrutiny emerged in the context of how the UN Commission handled claims regarding Hamas’ military tunnels found beneath medical facilities, particularly under Al-Shifa Hospital. Although the commission confirmed the existence of a tunnel, it was unable to establish that it was intended for military pursuits.

Dr. Tal Mimran from Hebrew University emphasized to Fox News Digital that simply the presence of the tunnels justified Israel’s entry into these hospitals. He argued that even if the tunnels were associated with non-combat activities, such as housing or recuperation for Hamas operatives, they still constituted legitimate military targets. While he asserted the necessity of minimizing any detrimental impact on hospital operations, he reinforced Israel’s right to act against facilities exploited for militant purposes.
